The
school is responsible for its pupils and has a Duty of Care to them
whilst in their care both on and off of school premises. The school
is responsible for producing an anti-bullying policy and a behaviour
policy. The school is responsible to ensure that all members of
staff are agreed and understand the policy. Implementation of the
policy must be sanctioned. Monitoring incidences and recording them
on record must be maintained.

Evaluating whether the policy implemented is working needs to be
reviewed every year.
Head
Teachers by law must implement policy to prevent all forms of
bullying. Head teachers will need to satisfy themselves that their
policies comply with the Human Rights Act 1988 and the Race
Relations Amendment Act 2000. Schools are not directly responsible
for bullying off their premises, although exceptionally failure to
take disciplinary steps to combat harmful behaviour outside the
school might breach the schools common law duty of care. |
